SUGARSNAP MEDIA SUBMISSION TERMS

These Submission Terms ("Submission Terms") govern any Submission that you submit to SugarSnap Media through the Services. By submitting any Submission, you acknowledge that you have read, understood, and agree to these Submission Terms, the Terms of Use, and the Privacy Policy.

1. Definitions

"Submission" means any idea, concept, story, character, format, treatment, script, artwork, illustration, animation, audiovisual material, pitch deck, presentation, project proposal, creative material, portfolio material, or other content or information submitted to SugarSnap Media through the Services.

2. Eligibility

You represent and warrant that:

  • You are at least eighteen (18) years of age;
  • You have the full right, power, and authority to submit the Submission;
  • You own or control all rights necessary to submit the Submission and grant the rights described in these Submission Terms; and
  • Your Submission does not violate the rights of any third party.

3. No Confidential Relationship

You acknowledge and agree that:

  • Your Submission is submitted voluntarily and on a non-confidential basis;
  • SugarSnap Media is under no obligation to maintain any Submission in confidence;
  • No confidential, fiduciary, agency, partnership, joint venture, employment, or similar relationship is created by your Submission; and
  • SugarSnap Media will not be restricted from developing, acquiring, producing, financing, licensing, distributing, or exploiting materials that may be similar to your Submission.

Nothing herein shall create any obligation of confidentiality unless expressly set forth in a separate written agreement signed by an authorized representative of SugarSnap Media.

4. No Obligation to Review or Develop

SugarSnap Media has no obligation to:

  • Review any Submission;
  • Acknowledge receipt of any Submission;
  • Provide feedback regarding any Submission;
  • Return any Submission;
  • Preserve any Submission;
  • Select any Submission for a Program;
  • Match you with collaborators;
  • Provide funding or support;

Develop, acquire, purchase, option, finance, produce, distribute, market, or otherwise exploit any Submission.

Any decision regarding a Submission shall be made in SugarSnap Media's sole discretion.

5. License to Evaluate and Administer Programs

You grant SugarSnap Media a worldwide, non-exclusive, royalty-free license to use, reproduce, store, display, transmit, distribute internally, evaluate, analyze, review, and otherwise use the Submission as reasonably necessary to:

  • Evaluate the Submission;
  • Administer the Services and Programs;
  • Facilitate creator matching and collaboration;
  • Share the Submission with employees, contractors, advisors, evaluators, child development experts, mentors, and other persons involved in evaluating or administering Programs; and
  • Exercise SugarSnap Media's rights and perform its obligations under the Terms of Use and applicable Program requirements.

6. Similarity and Independent Development

You acknowledge that SugarSnap Media, its affiliates, users, participants, collaborators, advisors, licensors, contractors, and partners may currently be developing, have developed, or may in the future develop ideas, concepts, stories, characters, formats, artwork, audiovisual works, projects, or other materials that are similar to all or part of your Submission.

You agree that SugarSnap Media shall be free to develop, acquire, produce, finance, distribute, license, exploit, or otherwise use any materials that are independently created, independently developed, obtained from third parties, or otherwise lawfully acquired, even if such materials are similar to your Submission.

You shall not be entitled to compensation solely because any project, content, production, or other material developed, produced, financed, distributed, or exploited by SugarSnap Media or any third party is similar to your Submission.

7. No Compensation

No compensation, payment, credit, royalty, ownership interest, participation, or other consideration shall be due in connection with any Submission unless expressly set forth in a separate written agreement signed by SugarSnap Media.

8. Ownership

Except as otherwise provided in a separate written agreement, you retain ownership of your Submission.

Submission of materials to SugarSnap Media does not transfer ownership of the Submission to SugarSnap Media.

Any ownership, authorship, credit, compensation, revenue participation, development rights, production rights, derivative rights, or other rights relating to any Program, collaborative project, pilot, audiovisual work, or other project shall be governed solely by a separate written agreement among the applicable parties.

9. Entire Agreement Regarding Submissions

These Submission Terms, together with the Terms of Use and Privacy Policy, govern your Submission unless superseded by a separate written agreement executed by SugarSnap Media and the applicable participant(s).
